These Terms of Service govern your access to and use of BriefBop, the AI-powered creative intelligence platform for advertising professionals. Please read them carefully before using our Service.

1. Acceptance of Terms
By creating an account, accessing, or using BriefBop (the “Service”), operated by BriefBop, Inc. (“BriefBop,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”), our Privacy Policy, and our End User License Agreement (EULA), and all applicable laws and regulations. You must accept the EULA during account registration before you can use the Service.
If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms. In that case, “you” and “your” will refer to that organization.
2. Account Terms
2.1 Account Creation
To use BriefBop, you must create an account by providing accurate, complete, and current information. You must be at least 16 years old to create an account. You are responsible for maintaining the confidentiality of your account credentials.
2.2 Account Security
You are responsible for all activity that occurs under your account. You must immediately notify us at security@briefbop.com if you suspect unauthorized access to your account. BriefBop will not be liable for any loss or damage arising from unauthorized use of your account.
2.3 Team & Organization Accounts
If you create or manage a team workspace, you are the administrator and assume responsibility for all team members' compliance with these Terms. You control access permissions and are responsible for managing team membership.
3. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You specifically agree not to:
- Use the Service to generate content that is illegal, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable.
- Attempt to gain unauthorized access to the Service, other accounts, or computer systems or networks connected to the Service.
- Reverse engineer, decompile, disassemble, or attempt to discover the source code or underlying algorithms of the Service.
- Use the Service to build a competing product or copy any features, functions, or graphics of the Service.
- Use automated means (bots, scrapers, crawlers) to access the Service without our express written permission.
- Transmit any viruses, malware, or other malicious code through the Service.
- Interfere with or disrupt the integrity or performance of the Service or its infrastructure.
- Use the Service to generate misleading or deceptive advertising content that violates applicable advertising standards or regulations.
- Exceed rate limits or usage quotas in a manner that degrades the Service for other users.
4. Intellectual Property
4.1 BriefBop's Intellectual Property
The Service, including its design, features, code, documentation, AI models, algorithms, trademarks, and all related intellectual property, is and remains the exclusive property of BriefBop, Inc. and its licensors. These Terms do not grant you any right, title, or interest in the Service beyond the limited license to use it as described herein.
4.2 Your Content
You retain all rights to content you upload or create using the Service (“Your Content”). By uploading Your Content, you grant BriefBop a limited, non-exclusive, worldwide, royalty-free license to use, process, and store Your Content solely for the purpose of providing and improving the Service.
4.3 Feedback
If you provide feedback, suggestions, or ideas about the Service, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate that feedback into the Service without any obligation to you.
5. AI-Generated Content
Important: AI Content Ownership
This section governs the ownership and usage rights of content generated by BriefBop's AI features. Please read it carefully.
5.1 Ownership of Output
Subject to these Terms, you own the output generated by the Service based on your input (“AI Output”). You are free to use, modify, distribute, and commercialize AI Output for your business purposes, including in advertising campaigns and creative materials.
5.2 Similarity of Output
Due to the nature of artificial intelligence, other users may receive similar or identical output from the Service when providing similar input. BriefBop does not guarantee that AI Output will be unique, and we do not claim exclusive rights to AI Output on your behalf.
5.3 Accuracy & Review
AI Output is generated by multiple machine learning models (including Claude, GPT-4o, and Gemini) working in parallel and may contain errors, inaccuracies, or biases. BriefBop reserves the right to change, add, or remove AI model providers at any time without notice. You are solely responsible for reviewing, verifying, and editing all AI Output before use. You must ensure that AI Output complies with applicable laws, advertising standards, and industry regulations before publication.
5.4 No Warranty on AI Output
BriefBop makes no warranties regarding the accuracy, completeness, originality, or fitness for purpose of any AI Output. AI Output should not be relied upon as legal, financial, medical, or professional advice.
6. Subscriptions & Billing
6.1 Plans & Pricing
BriefBop offers various subscription plans with different feature sets and usage limits. Current pricing is available on our website. We reserve the right to change pricing with 30 days' notice to existing subscribers.
6.2 Billing Cycle
Subscriptions are billed in advance on a monthly or annual basis, depending on the plan you select. Your subscription will automatically renew at the end of each billing cycle unless you cancel before the renewal date.
6.3 Refunds
All fees are non-refundable except as required by applicable law. If you cancel your subscription, you will retain access to paid features until the end of your current billing period.
6.4 Free Trials
We may offer free trials at our discretion. At the end of a free trial, your account will be converted to a paid subscription unless you cancel before the trial ends. We will notify you before the trial expires.
7. Service Availability
We strive to provide the Service with high availability but do not guarantee uninterrupted, error-free, or secure access. The Service may be temporarily unavailable due to:
- Scheduled maintenance (with advance notice when possible).
- Unscheduled downtime caused by technical issues, security incidents, or force majeure events.
- Third-party service outages affecting our infrastructure providers.
For enterprise customers, service level agreements (SLAs) with specific uptime guarantees may be available under separate written agreements. BriefBop is not liable for any damages or losses resulting from Service unavailability.
8. Limitation of Liability
To the maximum extent permitted by applicable law, BriefBop and its affiliates, officers, directors, employees, agents, suppliers, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, goodwill, or other intangible losses, resulting from:
- Your use of or inability to use the Service.
- Any unauthorized access to or alteration of your data or transmissions.
- Any AI Output generated by the Service, including errors, inaccuracies, or inappropriate content.
- Actions taken based on AI Output or other content produced by the Service.
- Any third-party conduct or content on the Service.
In no event shall BriefBop's total aggregate liability exceed the greater of (a) the amount you paid for the Service in the twelve (12) months preceding the claim, or (b) one hundred U.S. dollars ($100).
9. Indemnification
You agree to indemnify, defend, and hold harmless BriefBop, its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property rights; (d) any content you submit, post, or transmit through the Service; or (e) your use or publication of AI Output in a manner that violates applicable laws or regulations.
10. Termination
10.1 Termination by You
You may terminate your account at any time through your account settings or by contacting our support team. Upon termination, your right to use the Service will cease immediately. You will not receive a refund for any remaining subscription period.
10.2 Termination by BriefBop
We may suspend or terminate your account at any time if we reasonably believe you have violated these Terms, if required by law, or if we determine that your use poses a risk to the Service, other users, or third parties. We will provide notice of termination when reasonably possible.
10.3 Effect of Termination
Upon termination, you may request an export of Your Content for up to 30 days. After 30 days, we may permanently delete Your Content from our systems. Sections of these Terms that by their nature should survive termination will survive, including intellectual property, limitation of liability, indemnification, and governing law provisions.
11. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation within 30 days, either party may submit the dispute to binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.
You agree that any arbitration or legal proceedings shall be conducted on an individual basis and not as a class action, consolidated action, or representative action. Nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide at least 30 days' notice of material changes by posting the updated Terms on our website, sending an email notification, or displaying a prominent notice within the Service. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service and terminate your account.
